L'ordonnance, que l'Agence France-Presse a pu consulter, est datée de mercredi 21 août. Les juges y estiment qu'il « n'existe pas de charges suffisantes » contre Agathe Habyarimana, « qu'elle ait pu être complice d'actes de génocide » ou qu'elle ait pu « participer à une entente en vue de commettre le génocide ».

À ce jour, poursuivent les juges, Agathe Habyarimana « apparaît non comme auteure de génocide, mais bien comme une victime » de l'attentat terroriste dans lequel ont été tués son mari, son frère et des proches.

La perspective d'un procès pour Agathe Habyarimana s'éloigne donc fortement, alors que cette affaire a donné lieu à un véritable bras de fer entre les juges d'instruction et le parquet national antiterroriste. Ce jeudi 21 août, le parquet national antiterroriste (Pnat) a indiqué qu'il allait faire appel. Le Pnat « entend relever appel de cette décision, rendue alors même qu'un recours » doit être examiné, explique le ministère public à l'AFP. Le 15 mai 2025, les juges avaient déjà rendu une ordonnance exposant leur point de vue.

Selon les associations de victimes, Agathe Habyarimana était l'une des dirigeantes de l'« akazu », le premier cercle du pouvoir hutu qui a orchestré le génocide des Tutsis en 1994. Ce qu'elle réfute.
