The head of the European Court of Human Rights says countries have a "clear legal obligation" to follow its injunctions, despite UK ministers considering ignoring them.

The government's Rwanda bill aims to stop legal challenges against plans to send asylum seekers to the country.

In June 2022, the ECHR stopped the first Rwanda flight, saying British judges had not ruled on the plan.

It comes as the House of Lords prepares to debate the Rwanda bill next week.

Downing Street said the government was confident its Rwanda legislation was compliant with the UK's international obligations.

The legislation, passed by MPs last week, could face substantial opposition in the Lords - and ministers have formally admitted in a statement that it may breach the European Convention on Human Rights.

A key element of the government's plan would allow ministers to ignore the Strasbourg-based court's so-called Rule 39 orders - more commonly known as a court injunction.

In June 2022, an ECHR judge used that power to temporarily stop the first Rwanda flight, until the migrants on board had had a chance to put their case to British judges.

That delay in the flight allowed the migrants to take their case to the UK Supreme Court, which ruled last year that the entire plan was unlawful.

Speaking to journalists at the ECHR's annual press conference, the court's president, Siofra O'Leary, said: "There is a clear legal obligation under the [European Convention on Human Rights] for states to comply with Rule 39 measures.

"The court issues interim measures in exceptional circumstances where there is a real and imminent risk of irreparable harm."

While she did not comment directly on the political row over the Rwanda plan, President O'Leary said: "Rule 39 measures are almost always sought in situations of urgency, if not extreme urgency.

"And the nature of the urgency, or the degree of urgency, is something which governments control. The court doesn't control the degree of urgency."

She said that in 2023 the court had received 61 requests to make an emergency intervention against the UK. Only one of those had been granted as genuinely necessary.

Separately, in 2021 the UK had urged Moscow to comply with one of the court's Rule 39 orders, demanding the release of jailed opposition leader Alexei Navalny. And last year another order had helped save the lives of two British fighters in Ukraine who had been taken captive by Russian forces.

"[The UK] has always complied with Rule 39 measures going all the way back to the...1950s and stays of execution," she said.

"In only one case, to my knowledge...did the UK fail to comply...but the factual circumstances of that case, were very particular."

Prime Minister Rishi Sunak said: "I've been very clear, I won't let a foreign court stop us from getting flights up and running."

He said his Rwanda bill included a "specific power", allowing ministers to decide whether to ignore the court's rulings.

"I would not have put that power in there if I wasn't prepared to use it," he added.

Downing Street argued that its treaty with Rwanda and the bill addressed the concerns raised by the Supreme Court, and ministers had "created the conditions" to avoid legal challenges.

"There should be no need for Strasburg to intervene to block flights in the way they did in 2022," the prime minister's official spokesman added.

While the judge said she could and would not comment on the UK government's plans for new legislation over Rwanda, her intervention will embolden critics who are piling pressure on the House of Lords to stop the plan.

Peers have already defeated the government in a symbolic vote over approving the UK's new treaty with Rwanda - saying that it should not come into force until the African nation has passed new laws to make its asylum system fairer.

Les Forces Armées de la République Démocratique du Congo (FARDC) ont capturé deux mercenaires blancs américains à Mweso qui combattaient aux côtés des rebelles du Mouvement du 23 Mars (RDF/M23).

Dans la nuit du mardi 23 au mercredi 24 janvier 2024, les affrontements entre l'armée congolaise FARDC et le mouvement rebelle M23 se sont intensifiés dans la ville de Mweso, située dans le territoire de Masisi, au Nord-Kivu. Au cours de ces combats, l'armée congolaise affirme avoir capturé deux mercenaires blancs de nationalité américaine.

Selon un communiqué des FARDC, les deux mercenaires ont été capturés alors qu'ils combattaient aux côtés des rebelles de RDF/M23. Ils ont été identifiés comme étant deux hommes âgés de 35 et 40 ans, originaires du Texas et de l'Arizona. Les deux mercenaires ont été remis aux autorités judiciaires congolaises et sont actuellement en détention à Goma, la capitale provinciale du Nord-Kivu.

Cette capture représente un revers pour le RDF/M23, qui est accusé de recruter des mercenaires étrangers pour soutenir sa campagne militaire. Les États-Unis ont condamné cette pratique et ont déclaré qu'ils prendraient des mesures contre les personnes impliquées.

La capture de ces deux mercenaires est également un signe de la détérioration de la situation sécuritaire au Nord-Kivu. La région est en proie à une guerre civile depuis des décennies, et les combats entre les groupes armés se sont intensifiés ces derniers mois.

Les affrontements à Mweso ont fait au moins 10 morts et des dizaines de blessés, selon la société civile locale. Les combats ont également entraîné le déplacement de milliers de civils. La situation sécuritaire au Nord-Kivu suscite une préoccupation majeure pour la communauté internationale. Les Nations Unies ont appelé à un cessez-le-feu immédiat et à un dialogue entre les parties en conflit.

Rwanda hotel dissident denied food and medicine in prison, family says

NAIROBI, Kenya – Paul Rusesabagina, the prominent dissident who was portrayed in the Oscar nominated film "Hotel Rwanda", is denied food and medicine at a prison in Rwanda where he is being held on terrorism-related charges , according to his family, lawyers and foundation, even as the 66-year-old complained of poor health.

Mr Rusesabagina told members of his family that prison officials had informed him that they would cut off his access to food, water and medicine from Saturday.

His family and lawyers believe the Rwandan authorities' decision was an attempt to pressure him to return to his trial, which he stopped attending in March after saying he did not expect get justice. Mr. Rusesabagina, the former hotelier whose efforts to save more than 1,200 people during the country's genocide were featured in "Hotel Rwanda", later became a critic of President Paul Kagame's government.

No official reason was given for the new order, and Johnston Busingye, Rwanda's attorney general and justice minister, who oversees the country's prison system, did not immediately respond to calls and a text seeking comment .


 

Mr Rusesabagina's lawyers were due to visit him on Friday but were refused entry to the prison, his lead counsel, Kate Gibson, said. Describing the latest developments as "disturbing," Ms Gibson said the legal team had made an "urgent submission" to the United Nations Working Group on Arbitrary Detention to request an investigation into Mr Rusesabagina's situation.

"It is difficult to imagine a situation of more direct and deliberate harm to an inmate, especially an inmate in poor health," Ms. Gibson told The New York Times.

Mr. Rusesabagina was arrested last August and charged with nine offenses, including murder and forming an armed group accused of organizing deadly attacks in Rwanda. A Belgian citizen and permanent resident of the United States, he had traveled from his home in San Antonio, Texas, to join Constantin Niyomwungere, a pastor who he said invited him to speak to his churches in Burundi, neighboring Rwanda. .

Mr. Rusesabagina was unaware that Mr. Niyomwungere was working as an agent of the Rwandan government and had participated in a plan to attract him to the country. After meeting in Dubai, the two men boarded a private jet that Mr. Rusesabagina thought was going to Burundi – to land in Kigali on August 28 where he was summarily arrested.

Rwandan authorities said Rusesabagina was traveling to Burundi to meet with rebel groups based there and in the border Democratic Republic of Congo.

In the days leading up to his press briefing on August 31, Mr. Rusesabagina was left hand and foot bound, unable to breathe properly or use the toilet, and detained in a place he described as a "slaughterhouse. Where he heard the screams. other detainees, according to a sworn statement from one of his Rwandan lawyers, Jean-Félix Rudakemwa.

Murangira B. Thierry, spokesperson for the Rwanda Investigation Bureau, denied the allegations in the affidavit. The office, he said, "is a professional investigative body which respects human rights."

Mr Rusesabagina's lawyers say they have not only been banned from visiting him, but must also submit any documents they wish to share with him to the authorities in the first place. Previously, all notes lawyers took in meetings with him had to be reviewed by prison officials before they could be released from prison, Ms Gibson said.

 

"Denied access to lawyers of his choice, to the case against him, to the time and resources to prepare his defense," Ms. Gibson said, "the proceedings against Mr. Rusesabagina systematically violated his rights as an accused, to the point that he chose not to participate anymore.

Mr Rusesabagina's family and lawyers say his health has deteriorated since his arrest and he has expressed fears of dying of a stroke.

"The fact that the doctor provided by the Rwandan government prescribed three bottles of water a day, and he is not receiving them, is of particular concern," Kitty Kurth, spokesperson for his foundation, said in a statement on Friday.

Mr. Rusesabagina is a cancer survivor, has cardiovascular problems and complains of severe back pain.

"My family is very scared and worried," Rusesabagina's daughter Anaise Kanimba said on Saturday. "We don't know if his health will come through. We don't know when we'll talk to him next time. It is devastating. "
